Results of Winning Verdicts and Settlements

Austin Mehr has litigated truck wreck cases for over 30 years. One of his first victories was representing a client in 1992 where he recovered a $420,000 verdict after a trial involving a garbage truck colliding with his client. The client had a herniated disc in her neck and required surgery.

Dozens of cases followed that landmark verdict. He soon thereafter represented a client in Estill County and obtained the largest verdict in that county ever ($770,000) when the client was critically injured by a wreck.

Mehr represented a seriously injured client following an automobile crash and her carrier refused to cover the accident. He succeeded in getting the judgment that the driver was working at the time of the wreck, thus insuring payment for the injury.

Mehr's most recent result was for a client who received $1.5 million when he was injured as a result of a wreck with an 18 wheeler.

He has represented many clients in jury trials for both injury and wrongful death, and many of those cases have led to bad faith claims for insurance companies not being fair in their treatment of the victims. He recently had a bad faith verdict against an insurance company for $15 million.

Bartley Hagerman represented the injured occupant of a pick-up truck that was struck by a Greyhound bus on I-70 in Trego County, Kansas on April 30, 2014. One of the other occupants of the pick-up truck died at the scene and more than a dozen passengers on the Greyhound bus sustained injuries. There were statements from numerous witnesses showing that the Greyhound bus driver was driving erratically and crossed over the line, colliding with the pick-up truck which flipped over.

MFPTL was able to obtain a settlement for the injured occupant of the pick-up truck that was struck by the Greyhound bus.

MFPTL has also recovered millions of dollars through successful appeals arising from cases involving serious injury or death. Recently, MFPTL obtained an additional million dollars of insurance coverage for the estate of a man who was tragically struck and killed by a tractor trailer on an interstate highway. (See Gen. Star. Indem. Co. v. Withrow, No. 2014-CA-001519-MR, 2015 Ky. App. Unpub. LEXIS 591 (Ct. App. Aug. 14, 2015).).

How Does the Criminal or Traffic Case Relate to a Personal Injury Claim or Lawsuit?

A criminal or traffic charge can impact a civil suit for personal injury. If the crime or traffic charge arises out of the same facts and circumstances which create civil liability, a conviction or guilty plea on such charges can be used against the offender in a civil proceeding. But, being found not guilty of criminal charges or traffic violations does not absolve the offender of liability for damages caused to another in a civil proceeding. They are different standards.
