However, using AI to communicate in long-term disability claims governed by the Employee Retirement Income Security Act (ERISA) can pose certain dangers.</p>

<p>Insurance companies will often seize any angle they can to minimize or deny the payout for a claim. One particular approach that these companies have been known to employ involves the exploitation of concise, well-written summaries, emails, or medical records provided by a claimant. Moreover, they might even leverage such articulated documents that were compiled with the assistance of AI. For instance, the company might argue that the claimant is not disabled or ill to the extent they claim if they are capable of putting together a lengthy medical history or appeal. By suggesting that the very ability to write a comprehensive, structured document contradicts the severity of the claimed disability or medical condition, the company may try to avoid its obligations and refuse to approve benefits.</p>

<p>If you have been involved in a car accident that was not your fault, you may be entitled to compensation for your injuries, including medical bills, lost wages, property damage to your vehicle, and pain and suffering. But how do you know whose fault the collision was? If the other driver ran a red light or rear-ended you while you were stopped at a light, this question might yield a simple answer. Many times, however, the other driver won’t admit to causing the collision or might even blame you for causing it.</p>



<p>Driving in Kentucky comes with a clear set of responsibilities designed to keep motorists, passengers, and pedestrians safe. These rules are primarily found in KRS Chapter 189 of the Kentucky Revised Statutes and apply to anyone operating a vehicle on public roadways.</p>



<p>The most basic rule is that everyone is required to operate their vehicle in a careful manner with regard to the safety of others. This means that drivers should be aware of their surroundings, and avoid aggressive driving, excessive accelerations, or dangerous lane changes. Drivers should adjust their driving for weather, traffic, and road conditions.</p>



<p>Kentucky law requires drivers to travel at a speed that is “reasonable and prudent” for conditions. Standard maximum limits are generally 70 mph on rural interstates, 65 mph on urban interstates and parkways, 55 mph on many other highways, and 35 mph in residential or business districts, unless otherwise posted. Speeds must be reduced in school zones and during hazardous conditions like rain, fog, or ice.</p>



<p>Drivers must comply with all official traffic control devices, including stop signs, yield signs, traffic lights, and lane markings. Running a red light or ignoring a stop sign is a violation. At four-way stops, drivers yield to the vehicle that arrives first. When turning left, you must yield to oncoming traffic. Drivers must stay in their lane of travel, should not swerve out of their lane into oncoming traffic, and must follow specific rules for passing and overtaking slower vehicles in front of them.</p>



<p>Drivers must have their headlights on ½ hour after sunset to ½ hour before sunrise, or at other times where the conditions render visibility low.</p>



<p>Vehicles should generally be kept in good working order, with brakes, brake lights, horns, and steering devices to be reasonably safe. Vehicles should avoid obstructions that would make it difficult for the driver to see.</p>



<p>Right-of-way rules are central to preventing collisions. Kentucky drivers must yield to pedestrians in crosswalks, to vehicles already in an intersection, and to emergency vehicles using lights and sirens. If an emergency vehicle approaches an intersection with its lights and sirens activated, it has the right of way even if its traffic signal is red. When approaching stopped emergency vehicles or certain roadside vehicles with flashing lights, drivers must move over when safe to do so.</p>



<p>Likewise, when a school or church bus displays flashing red lights and an extended stop arm, traffic behind the bus must stop. Traffic in both directions must stop unless the roadway is a four-lane highway.</p>



<p>Driving under the influence of alcohol or drugs is not permitted. Generally speaking, a blood alcohol concentration (BAC) of 0.08% or higher constitutes DUI for most drivers, with stricter standards for commercial drivers and those under 21. Texting while driving is also prohibited, and drivers under 18 face additional cellphone restrictions.</p>

<p>The Employee Retirement Income Security Act (ERISA) was established to safeguard employees’ interests in retirement and health benefits offered by their employers. It sets standards to ensure that benefit plans are adequately managed and that employees are informed about their rights and plan details. <p>It is common for employees to obtain long-term disability coverage through their employment as an employee benefit. These policies are typically governed by a federal law called ERISA (this stands for the Employee Retirement Income Security Act). Having access to this coverage should provide comfort to employees in case the unthinkable happens: some life altering event that leaves you disabled and unable to continue working – physically or mentally.  However, typically insurance policies contain language that employees aren’t often aware. For example, most disability insurance policies <strong>limit </strong>how long benefits will be paid for any conditions that the insurance company considers to be a “mental illness” or “mental health condition.” Most disability policies limit the maximum disability benefit period for mental health conditions to a maximum period of 24 months of benefits (although it is possible some policies have a shorter, or even longer, benefit period – every policy is different). Opposite of this, most policies have a much longer disability benefit period for conditions that are considered “physical” conditions (for example, most policies pay benefits to ages 65 or 67 for physical conditions).</p>



<p>Why is there such a disparity in how physical and mental conditions are treated by disability insurance carriers? There shouldn’t be – and other types of coverage (such as health insurance) do not have this disparity. However, action is now being taken to try and make this change for disability policies. The <a href="https://www.dol.gov/sites/dolgov/files/ebsa/about-ebsa/about-us/erisa-advisory-council/2023-long-term-disability-benefits-and-mental-health-disparity-issue-statement.pdf" rel="noopener noreferrer" target="_blank">2023 ERISA Advisory Council</a> has taken a focus on this very issue this year. Their goal has been to “<a href="https://www.dol.gov/sites/dolgov/files/ebsa/about-ebsa/about-us/erisa-advisory-council/2023-long-term-disability-benefits-and-mental-health-disparity-issue-statement.pdf" rel="noopener noreferrer" target="_blank">study the scope and impact of employee benefit plans’ limitations on disability benefits for mental health and substance use conditions</a>.”</p>



<p>The ERISA Advisory Council has now urged Congress to pass legislation for mental health parity in disability policies. And, since this news, <a href="https://www.prnewswire.com/news-releases/sun-life-us-calls-for-mental-health-parity-in-disability-insurance-302013335.html" rel="noopener noreferrer" target="_blank">a large disability insurance carrier – Sun Life – has vocalized support for mental health parity</a>. Sun Life, in a press release, stated:

Getting people back to health and back to work whenever possible remains the goal, and providing good mental health benefits to bridge people through times when they can’t work is a good investment.</a></p>

<strong>Support such as this is significant and cannot be emphasized enough.</strong> Mental health conditions should be given the same priority and review that physical conditions are given under ERISA disability policies. <p><strong>On June 15, 2023, Mehr Fairbanks obtained a <a href="https://appellatepublic.kycourts.net/api/api/v1/publicaccessdocuments/b0c31af586f7ea68974ceca5cfc2aa14b8e047dbaa71b799d0a875e2a3b91f24/download" rel="noopener noreferrer" target="_blank">favorable opinion from the Kentucky Supreme Court</a> related to a <a href="/blog/jury-awards-15-million-in-mineral-rights-case/">more than $15 million trial verdict in Magoffin County that Mehr Fairbanks obtained for its clients</a> in October 2018. Following the jury’s verdict, the case was appealed by the insurance company. </strong><strong>With the most recent decision, the Kentucky Supreme Court reversed a decision on appeal by the Kentucky Court of Appeals. T</strong><strong>he Supreme Court held that Kentucky case law “should not be construed as requiring a final judicial determination of coverage prior to filing a third-party tort claim against an insurer.” Importantly, the Court held that “the longstanding requirements of <em>Wittmer v.</em> <em>Jones</em>” continues to apply in insurance bad faith claims. </strong></p>

<p>Disability insurance is a unique type of insurance that protects a person’s ability to earn a paycheck if that person experiences a serious injury or illness. Disability insurance is meant to provide employees with a way to receive a portion of their expected income if they later become unable to work. Disability insurance is often categorized as either short-term or long-term. The primary difference between short-term and long-term disability plans are the periods of time a person may receive benefits due to her inability to work. Short-term disability plans usually work in tandem with long-term disability plans. Generally, once short-term benefits are exhausted, then a long-term disability policy would become effective in an effort to continue providing an employee with income until she is able to return to work. Some long-term disability plans may last for the lifetime of the policyholder, most will usually provide coverage for approximately thirty-six (36) months.</p>


<p>Most employers provide some type of disability insurance coverage for their employees. It might be time to refresh your memory on what your employer provides you with specifically. In an unpublished opinion, the Ninth Circuit recently determined that an employer provided disability insurance company was within its rights to reduce an employee’s disability benefits by $800,000. The $800,000 came from a recent personal injury settlement the employee received on a completely unrelated matter.<em> Haddad v. SMG Long Term Disability Plan</em>, No. 16-CV-01700-WHO, 2021 WL 2187979 (E.D. Cal. May 28, 2021).</p>


<p>The case turned on the legal distinction between “<strong>offsets</strong>” and “<strong>exclusions</strong>” and “<strong>limitations</strong>” in regard to long-term disability plans. This marginal difference may be the difference between receiving the anticipated total value of long-term disability benefits or having that total value later diminished. <strong>Exclusions</strong> and <strong>limitations</strong> carve out areas from the scope of an insurance policy’s coverage. <strong>Offsets</strong> reduce the total amount owed for covered claims.</p>


<p>For example, in the case mentioned above, Mr. Haddad was an employee that received long-term disability benefits from his employer-sponsored insurance plan after becoming disabled. He received an $800,000 settlement for an unrelated matter and his disability benefits were reduced, or <strong>offset</strong>, by the amount he received in the settlement. Mr. Haddad challenged this offset and ultimately lost. The Ninth Circuit reasoned that <strong>offsets</strong> are distinctly different from exclusions and limitations and therefore the employer-sponsored insurance plan was within its rights to reduce Mr. Haddad’s disability benefits by the amount he received in his settlement.</p>


<p>The Ninth Circuit further stipulated that the employer-sponsored insurance plan was clear and unambiguous when it mentioned specifically in its long-term disability plan that disability benefits would be offset by any payments that were the result of a settlement or judgment to the insured employee. This long-term disability plan specifically did not require that the offsets to settlements be for related injuries. This long-term disability plan provider was also not required to draw attention to the language in its plan related to offsets based on settlements or judgments. Thus, even though Mr. Haddad received the settlement for something unrelated to his disability insurance it was still deemed okay for the employer-sponsored insurance provider to reduce his disability benefits by the settlement amount.</p>

<p>Towards the end of last year, the Department of Labor (“DOL”) released its final rule titled, “Prudence and Loyalty in Selecting Plan Investments and Exercising Shareholder Rights.” 87. Fed. Reg. 73822 (Dec. 1, 2022) (the “<strong>Socially Conscious Investing Rule</strong>”). This new rule is now in effect and the DOL stated one of the purposes of its new rule was to focus on “the chilling effect and other potential negative consequences caused by the previous rule, ‘Financial Factors in Selecting Plan Investments,’ 85 Fed. Reg. 72846 (Nov. 13, 2020), with respect to the consideration of climate change and other environmental, social, and governance (“ESG”) factors.” <strong>The Socially Conscious Investing Rule</strong> provides guidance related to the fiduciary duties of both prudence and loyalty, as applicable to the selection of plan investments. This new rule specifies that a “fiduciary’s determination with respect to an investment or investment course of action must be based on factors that the fiduciary reasonably determines are relevant to a risk and return analysis.” 29 CFR § 2550.404a-1(b)(4).</p>


<p>However, not everyone agrees with the <strong>Socially Conscious Investing Rule</strong> or its future impact on retirement plans managed by employers. For instance, twenty-five Republican state attorneys general formed an alliance and filed a lawsuit against the DOL. Kentucky is one of the states that joined in this lawsuit. In their complaint, the Republican attorneys general alleged that the new <strong>Socially Conscious Investing Rule</strong> violated the Employee Retirement Income Security Act (“ERISA”). In their complaint, the attorneys general are requesting that the U.S. District Court for the Norther District of Texas makes a declaration that the Socially Conscious Investing Rule is in direct violation of ERISA. “The 2022 rule undermines key protections for retirement savings of 152 million workers — approximately two-thirds of the U.S. adult population and totaling $12 trillion in assets — in the name of promoting environmental, social, and governance factors in investing, including the Biden administration’s stated desire to address climate change,” the complaint stated.</p>


<p>Their 46-page complaint states that in 2014, in <em>Fifth Third Bancorp v. Dudenhoeffer</em>, the Supreme Court unanimously concluded that ERISA requires fiduciaries to consider financial benefits and not any nonpecuniary benefits. Further, their complaint asserts that the exclusive purpose that ERISA fiduciaries must pursue are financial benefits. Also, the legislative history of ERISA supports the idea that the financial benefits alone should be the sole and exclusive purpose of the statute itself. ERISA’s fiduciary duties are the highest duties recognized by the law and therefore require that fiduciaries act with undivided loyalty towards the beneficiaries.</p>


<p>To comply with the new <strong>Socially Conscious Investing Rule</strong>, employer plan fiduciaries may need to explicitly document in their investment policy statements precisely how investment managers should evaluate financial factors when comparing different investment strategies. Also, employer plan fiduciaries are still required to ensure that investments or investment alternatives meet the financial risk and return analysis required by the duty of prudence. For example, if an employer plan fiduciary wanted to include an ESG investment option, the fiduciary should still engage in a prudent process documenting why it’s more probable the investment would produce superior risk-adjusted returns.</p>

<p>In the case of <em>Legacy Health Services, Inc. v. Illinois Union Insurance Co. and Columbia Casualty Co.</em>, Defendant Illinois Union Insurance Company filed a Notice of Removal, which transferred the case to federal court in the Western District of Kentucky. On behalf of the Plaintiff, Legacy Health Services, Inc.,  Mehr Fairbanks Trial Lawyers filed a motion to remand the case back to Christian Circuit Court. On October 14, 2021, the <a href="/static/2021/11/2021-10-14-doc-13-ORDER-remanding.pdf" rel="noopener" target="_blank">federal court granted Plaintiff’s motion to remand</a>, finding that Defendant Illinois Union Insurance Company had not met its burden of showing that removal was proper. Since the federal court did not have jurisdiction, removal was improper. The case has been remanded to state court.</p>

<p>In the Kentucky bad faith case of <em>Wright v. Allstate Property and Casualty Insurance Company</em>, Allstate refused to turn over its claim file except for a two-month window, even though the claim duration was from 2014 to 2019. MFP filed the case against Allstate for unfair claims settlement practices act violations, alleging delays in making a fair offer to Mr. Wright who was seriously injured in a car crash. The trial Court rejected Allstate’s argument and <a href="/static/2021/11/Wright-2021-08-04-ORDER-granting-mtc-003-0021.pdf" rel="noopener" target="_blank">ordered Allstate to produce the entire file</a>, which would include those portions of the claim file that was created after the bad faith claim was initiated.</p>


<p>The ruling follows Kentucky law that says claims files are potential evidence that the claimant lawyers should get to see, because they can provide proof of bad faith. An insurance company is required by law to record its activities in the claim file. This can provide an excellent record of what the Insurance company was doing, what they were really thinking, and what they were NOT doing.</p>
